Long-term Airbnb Guests Not Covered by Ontario Tenant Law: What You Need to Know!

The recent ruling by the Ontario Landlord and Tenant Board (LTB) has sparked a discussion about the status of long-term guests in Airbnb accommodations under tenant law. The decision could have significant implications for similar arrangements throughout the province, and the consequences of this ruling are raising concerns among housing advocates.
According to Thorben Wieditz, director of advocacy group Fairbnb Canada, the ruling creates a regulatory 'no man's land' for long-term rentals on the Airbnb platform. While sympathetic to the tenants' situation, the LTB determined that the 'travelling and vacationing public' exemption under Ontario's Residential Tenancies Act applied to their case. The tenants, a Swiss family, were staying in a Toronto Airbnb for a fixed period of time and the property was equipped with essential items.
This case highlights the ongoing debate about whether mid-to-long-term stays on platforms like Airbnb should be classified as tenancies and whether guests should have the same rights as traditional tenants. Tenant advocates argue that this creates a shadow rental market, leaving guests vulnerable to sudden cancellations without notice. Additionally, these listings fall outside the city's short-term rental regulations, potentially leading more landlords to consider this type of arrangement.
